Legal Question in Credit and Debt Law in Pennsylvania

lawsuit

i have power of attorney for my mother, who i recently enrolled in a debt management program. however, one of her creditors is suing her for the amount owed. would i be better off filing bankruptcy for her and can i do that as her power of attorney or should i answer the complaint and wait for the judgment or should i try to come up with some funds and settle with the creditor. please help.

The answer to this question will largely depend on three things: (1) the amount of debt that your mother has, (2) the nature of the debts, and (3) the value of her various assets. Of course, there are many other factors that I would need to consider, but I would start with those questions.

Your power of attorney MIGHT be broad enough to allow you to file bankruptcy on your mother's behalf.

Whether you should answer the complaint and/or try to settle with the creditor would depend on whether bankruptcy was an appropriate solution.
