should I get a lawyer

I received papers to appear for a Civil Court Hearing on Nov 23, 2004. I'm being sued by one of my credit cards. I have spoken with this law firm many times and explained our situation. My husband lost his job and was out of work for approx. 5 months. We prioritized our bills and paid the ''secured'' loans first. We have 2 young children so they came 2nd. Any of our credit cards came in dead last. The law firm knew what was going on and I told them I could only pay $50/ month until we got back on our feet. It took them almost 2 months to get to me to tell me that their client would accept the $50/month WITH A LEIN against our home. We have exhausted any routes for funds to pay this card and the many others. We have nothing. We are living from pay check to pay check. Our mortgage is almost paid current, along with our vehicles. I always intended on paying this and my other credit cards, but this company wouldn't take the little I offered until we could afford more. Should I obtain a lawyer? I know there will be a judgement against me. I'm really worried about being able to provide for my kids. We can't afford alot. How often do they ''freeze'' someone's checking account? No one seems to want to help. Advise, please.

The first question is how much are you being sued for. Also, are they asking for extra fees like late charges and attroney's fees. A judge may not allows those so it might make sense to defend the suit and let then get a reduced judgment. I offer free consultations and would be happy to discuss your particulars.

You should talk to an attorney. You have several courses of action, repayment plan, ignore, file bankruptcy etc etc.
