Levy of Property/Execution Sale
There has been a levy of our personal property/execution sale placed against us. What is the procedure for that after the date for the sale has been set? How do they go about claiming the property?

A sale will be scheduled. On that date your property will subject to sale. If the judgement is against a husband only, husband and wife can file a property claim indicating that the property is owned together as tenants by entirities. That is a special way legal title is held by husband and wife and would be exempt if you file a claim. A hearing will be scheduled on the claim. You should check with the Court or an attorney to assist you as to the procedure. Do not wait as time is working against you. Important that you act immediately. Filing bankruptcy will stop the sale and might preserve your property but wreck your credit. Consult an attorney immediately. If you can not afford an attorney go to Legal Aid for assistance.
