Legal Question in Credit and Debt Law in Pennsylvania

I live in Pa and I'm a SINGLE DISABLED mom and I receive Social Security Disability. I have a mortgage. I was sued by a credit card company and got a judgment against me. Can the creditor come and seize my personal property which some of it is NOT MINE or can they take my car? (My car is paid off and the value is $800.00). I live on $20.00 a week

Yes and no.

There is no exemption in PA for personal property like furniture, appliances and so on. But creditors do not really want your stuff. There is no value to most items unless you have antiques or brand new stuff that really has value. That said, I have seen one creditor in PA who does stoop to this level, although the creditor cannot seize and sell items which do not belong to you.

Can they take your car? Yes, if it is titled in your name solely and paid off. There also is no exemption in PA for motor vehicles as far as state court judgments go.

Depends on who the creditor is as to the likelihood of further execution efforts. If you would like to discuss this in confidence, email me at [email protected].
