Legal Question in Credit and Debt Law in Pennsylvania

loan to family member

I loaned a family member money and they repaid some of it but not all of it. Its been about 5 yrs since i recieved any payment. How long of a time frame do I have until its too late to go to small claims court? I have proof it was a loan and documentation of every payment recieved. Thank you for your help.

A loan is a contract. In contract cases, you have four years from the time when one party breaches the contract to go to court. So, four years from the time that they missed a scheduled payment.

However, it is possible that if you can get them to acknowledge that they owe you this money that you might be able to get the clock to start over.
