Legal Question in Credit and Debt Law in Pennsylvania

My mother passed away in Auguest 2010. She had no real estate, no assets. She has a balance on a Wells Fargo credit account. Is the family responsible to pay the balance?

No. Wells Fargo could bring an action against your mother's estate -- but it doesn't appear that one will even be opened since she left no assets. You could send a letter to Wells Fargo with a copy of the death certificate if you like . . . or not.

I agree. The family is not responsible. I would send a certified letter to the credit card company and advise that your mother passed on and their are not enough assets in the estate to warrant probate (from what you have rfelated, I assume this is the case) and that the family is not responsible for the debt. Include a copy of the death certificate.

I would be happy to draft this letter for a fee.
