Non-payment of Personal Mortage

I have a mortgage agreement with someone who has not paid me in 3 months. He has consulted an attorney to restructure his debt. Do I need an attorney too? What should I do to protect myself and insure collection? Should I file judgement? Should I file a notice with a credit reporting agency?

Unless he has filed for bankrupcy the only way to get your money or the property the mortgage secures is a complaint for mortgage foreclosure. Obviously the size of the mortgage would be determinative on spending money on an attorney. I offer free consultations.

Is your mortgage agreement written or verbal? When you say he is "restructuring debt," are you indicating that he has filed bankruptcy? The answer would differ based on whether or not he has filed bankruptcy. If he has not, you could go through the process of foreclosing on the mortgage.
