Who owes me?

In March 2005 I wrote a check to my brother's girlfriend and indicated in the memo section it was a loan for my brother. She deposited the funds in her checking account and used the money to pay a debt he incurred during home foreclosure, thus enabling her to proceed with buying his house (in her name only--the real estate transaction wouldn't go through until this amount my brother owed was paid). Who, legally, owes me back the money I lent, the girlfriend or my brother?

I think the answer is that your brother owes you the money because it was used to pay his debt, not the girlfriend's.
