Re-Aging a debt Past Statute of Limitations

If a collection agency purchases a debt

in PA, can they re-age it and extend the

statute of limitations? If the statute of

limitations is 4 years and it has been 6

years since the original creditor charged

off the credit card acct, can they ''open''

a new acct and start the date in 2006,

report it on my bureau, and double the

original debt? Keep in mind that I have

had not acknowledged the collector or

responded to any letters of collection.

The statute of limitations can not be extended. Howecve, if not raised in a legal action, it can be waived. Suggest you get a lawyer to stop collection agency from harassing you. I found a letter from an attorney is quite effective.

Nope, they can't do it, but they try it all of the time in an effort to get you to admit/acknowledge the debt, and thus start the statute of limitations over.

You should get an attorney to send them a letter telling them that the statute has run, and that if they persist in putting something on your credit report or otherwise seeking to collect a debt that they are well aware is beyond the statute that you will institute legal action against THEM.
