Received complaint papers filed for a credit card
Received complaint (Civil suit papers) filed by credit card company's collection agency. They show an exhibit, which is a statement dated 3/13/2003 - 4/13/2003. I pulled my credit report and date of last payment shows 5/2002. Is that enough proof to show in a SOL defense? I also need to know what form/how I can respond to the suit.

The defense of statute of limitations must be raised by pleading. You seem to have enough proof. However, I suggest you obtain legal counsel to insure you handle this matter properly. The action you take is different if you are in small claims court. The action you take Gerald Hershenson ESq.
