Legal Question in Credit and Debt Law in Pennsylvania

re:harrasment by

A close friend, actually sort-of adopted sister, has credit debt people calling her several times a day. They call her at work during the day and of course at home at night. Sometimes they don't even say anything. What is the limitation on the number of times that they can call in a week. I think that the company is out of Florida.

Credit collectors are subject to the Federal Fair Debt Collections and Practice Act. That act specifies the number where the calls can be made and the times of calls. It is my suggestion that you obtain an attorney. Inform the collection company that the debt is disputed and to refrain from contacting the individual at work. Refer all calls to the attorney. The collection company is prohibited from making further hassassing phone calls. However, there is obviously a debt that is due. Arrangements should be made to pay the debt. It may be possible to negotiate a reduction in the payoff. However, make sure a release or a letter is writing indicating the acceptance of payment in the reduced amount. Non payment of debts will effect the credit rating of the debtor and it will be reported on their credit report. Be careful. A violation of the Federal Act could subject the collection agency to payment of attorney fees and a penalty.
