Responsibility of Payment for Bill Incurred
Debitor used his father's credit card for renting equipment. Father wrote to bank declining the charges. Bank charged back on the rental and the Son is not paying. Filing suit...my question is should the father be added to the complaint? and is he anyway responsible for the bill incurred? Thank you for your time.

If the father permitted the son to use the card, the father should be liable on the debt. Or, if the father left the card around where the son could find it and use it, the father may have been negligent. However, typically the merchant must make some attempt to verify the signature against the card. If the signatures looked like they matched and you had no reason to know the son was using the father's card, you should be able to sue the father as well as the son.
