Sheriff Sale and Minors

If our property (things in the home) goes to a sheriff sale. (They already said they wouldn't take the house). But, I was wondering if they could take anything that belongs to my son. My son is 15 years old. The reason they are doing a sheriff sale is because of an unpaid credit card in my husband and my name. Can they take anything from my son?

You asked about a sheriff sale.

Yes, the sheriff can seize any personal property in the home. If the property is of a person not subject to the judgment then that person must file an action to either prevent the seizure or recover the improperly seized property.

You should immediately speak with an attorney and consider filing for protection in bankruptcy. This filing would forestall all collection actions and depending on your circumstances would allow you to eliminate most of your debt or create a schedule for repayment.
