If you win a judgement in small claims court related to work preformed at his residence what happens to the defendant if he doesn't pay? Is there a lien placed on the house?

Re: small claims judgements

You may be thinking of mechanics' liens. Generally they would not be applicable to your situation. The best way to execute upon a judgment is to attach a bank account. If he paid for materials and you kept a copy of his check you already have the name of his bank and his account number.

Re: small claims judgements

First wait for the appeals period. Generally 30 days. If no appeal filed make sure the judgment is showing up under the correct name in the court's judgment index.

They should give you a procedure to enforce the judgment including having the sheriff sell personal property.
