SOL and Credit Report Inquiry

Is it legal for a collection agency to pull a credit report on an account that is past SOL?

I believe it is legal and there are some collectors who will even file suit despite that the SOL has passed because the SOL is an affirmative defense that must be raised. It is very ethically questionable for an attorney to file suit in such circumstances but I've frequently seen it.
