Are you trying to sue your son? Your son and the girl? Or is your son trying to sue the girl? The reason I ask is that I can only discuss your matter with you. You say the money was borrowed. Was there a writing indicating that the money was to be repaid? Did you ever, in writing, ask for the money back? Was any amount repaid?
You have 4 years to sue from the time that the money was to be repaid. How much was borrowed? Anything under $8,000 and you can go to small claims court. If it was more than that, I recommend that you get a lawyer. You can still sue if you are outside the statute of limitations, however, it will depend on whether your son and/or his girlfriend are smart enough to raise the issue. If they do, the court will not allow you to recover. If they don't, then you are fine. However, I do not know when the statute of limitations period began to run.
I recommend that you at least consult with a civil litigation attorney. they can more specifically review your situation and tell you whether you can bring suit or not.
