Spouse accrued debt and is dying

Spouse accrued $5400 credit card debt solely in his name and is currently dying from cancer. Only asset is a house titled in both spouses' names. Can creditors claim against the house once husband has died? Thank you for your time.

On its face the creditors could not enforce their claim against your assets. The debt is your husband's and is not a lien against joint assets. That being said if the creditors can argue that the some of the debt was for necessary items, you could be responsible. I suggest you consult with legal counsel. Gerald Hershenson Esq.
