Legal Question in Credit and Debt Law in Pennsylvania
My spouse has debt is it my responsibility?!
My husband took a loan from a previous job without me knowing. He is no longer employed by this company and he never paid off the debt. He was found guilty in a Pennsyvannia court and ordered to pay the debt back. He never replied to notices to begin with payment of debt. In turn, police officers came to my home and made of list of all property within my home (sofa's, tables, wall unit, even my 10 month old's play pen and etc.) I don't feel this is fair or just, because i purchased all of these items with my own money from my own bank account and i have receipts to prove purchase from my bank statements. I know that we are married, but is that my responsibility to pay a debt off that was not made by me? Me and my children are suffering on account of his stupidity. Please help!

Re: My spouse has debt is it my responsibility?!
You have rights.
What you experienced is known as a levy and the person who conducted the levy is a deputy sheriff. The sheriff is charged with selling all items on the levy by a certain date, which must be provided to you at least 6 days in advance.
While you may file a levy objection and a hearing will be scheduled, the simplest, most effective solution is a bankruptcy for your husband. He should speak to an attorney ASAP to resolve this permanently, if possible.

You have a right to file a claim that the property is yours and that it should not be sold at sheriff's sale. There are time limits so act quickly. I offer free consultations.
