Statue of Limitations PA or NJ

I am currently being sued in PA (where I have been a resident for 4yrs) for 2 credit card debts I originated in NJ. The statue of limitations of 4 yrs has run out in PA. Can the collection agency resue in NJ because the SOL is 6 yrs?

I agree with Mr. Weinstein. You definitely want to file an answer in Pennsylvania, especially if the statute of limitations has run in PA. Credit card companies may be limited with respect to forum selection clauses by National and State Banking laws and, whether or not they are, if you prevail in the suits in Pennsylvania then the decisions would be entitled to full faith and credit in New Jersey.

Generally the law where the contract took place applies. In your original credit card agreement it may have indicated that in the event of a lawsuit a certain jurisdiction's law applies. You should meet with an attorney to further review this maer. In any event you must respond to the law suit or else a default judgement could be entered against you.
