Statute of limitations help
Hello,
After obtaining a copy of my credit report I found that there are 18 items listed in my account. 5 out of these 18 are valid, the rest are just buyers and resellers of the debt. Now these are all back in 1999-2001 and I was wondering if these are out of the statute of limitations or not. I read 4 years and I read 6 years. I asked them to stop calling me, they did butfor the past few YEARS call my grandmother where I used to live almost every day she gets calls. Also my old employer gets calls. What can I do?

Statute of limitations is normally 4 years. However, you can start the 4 years over by acknowledging the debt..."yes, that's my debt, but..." or by making a payment.
Their tactics may violate the law and, if so, you may have a cause of action against them. Consult an attorney familiar with the law on this topic to determine if you might be able to sue. My contact info is included with this email.

I suggest you consult an attorney. The statute may have run on the debt. You must request in writing that they not contact your employer. If you obtain the services of an attorney familar with the Federal Debt and Collections Practices Act he may be able to assist in stopping the harrassment. Gerald Hershenson Esq.
