Legal Question in Credit and Debt Law in Pennsylvania
Student Loan Credit Reporting
I had student loans that started showing on my credit reports in 2000. They defaulted in 2002 and I obtained a loan and paid them in full in 2002. There was only 3 loans and in 2002 they listed the 3 collections as well for a total of 6 on my reports. I disputed because according to the Metro2 Manual, when student loans go to collections they are supposed to delete the original loans, so there is no duplicate listings. Well the originals didn't come off till now. I keep disputing the collections and they refuse to remove these as well. I thought that collections could not be reported longer than the original debt could be (7 years) this reported for 8 and they will not remove the collections till 2009, which would total 9 years??? Everyone keeps telling me student loans are different but I cannot find anywhere that says student loans can report for more then 7 years, the only thing I keep coming back to is a debt can only be reported for 7 years. I don't know what else to do, I feel very strongly that these should not be on my reports anymore but they don't seem to care. Up until a few months ago they were reporting 'currently 180 days late' when it was paid in 2002.

Re: Student Loan Credit Reporting
I think that you are right. Unfortunately, being right doesn't solve your problem and it would probably cost you more than it's worth to file an action under the Fair Credit Reporting Act in federal court.
It may be a good class action. You may want to call around to a couple of big name firms to see if you can generate any interest in it but in the current environment I don't think you'll have much luck.
