I was sued for credit card by nco

I wrote before about an appeal by nco financial. I did some research and I have some questions. If only the attorney shows up for the hearing, move to dismiss. No plaintiff, no case. I have the right to cross examine the plaintiff and the attorney can't testify for their client. Also, I can demand to see the original contract that I signed. No contract, no claim. Is this all true?? The first hearing I had only the attorney showed up. If this is true I wish I would have known that then. They also did not have any information on any payments made, contracts or anything.

The problem is that if you show up, then they can cross examine you about the account, and you cannot lie. In these instances, hiring a consumer attorney to defend your interests is the way to go. We always recommend that our client stay home in these types of matters, unless the other side is bright enough to subpoena their attendance.
