Legal Question in Credit and Debt Law in Pennsylvania

Tuition reimbursement repayment

I participated in the tuition reimbursement plan at my former employer. Their policy is that 50% of the cost for each class that was completed in the past year must be repaid and that 100% repayment is required for any class completed withing the past 6 months. The only agreement I signed said I am aware of these facts and that I allow them to garnish any final payments due to me to cover the tuition costs owed to them. I recieved a notice from a collection agency stating that I owe close to $3000. I never signed a promissory note. Am I legally obligated to pay this amount back? Did my former employer have the right to sell this to the collection agency without a signed promissory note?

Thanks.

Re: Tuition reimbursement repayment

By taking the money and acknowledging the responsibility to pay back the money, you may have created a contract to do so. Any person or company can sell the legal right to collect the money to anyone else. A collection agency may have paid less than 50 cents on the dollar for the account so you should try and negotiate the amount. An attorney can be useful. The size of the debt is such that they may not pursue you with a suit as they would need to payattorney's fees and the agreement does not seem to provide you to pay them. I offer free consultations.
