Legal Question in Credit and Debt Law in Pennsylvania

Validity of College tuition debt

A year after graduation from college, I received a letter stating I owed $900 from a summer class taken a year before graduation and was threatened to be turned over to collections. The financial office claims this was an honest mistake. Before a student can graduate, they must receive conformation from the financial office that all debts are paid. Does the confirmation from the financial office and subseqent graduation infer that all debts are settled? Should I still be responsible for this ''discovered'' outstanding debt?

Re: Validity of College tuition debt

You asked about a remaining debt from college.

It depends on the wording of the confirmation but my position would be that the confirmation was a release of any and all claims from before the issuance of the confirmation.

That defense may or may not fly in court. But I would certainly make the collector work for the money. Also, watch to see if the collector violates the FDCPA. Nothing is more rewarding than nailing a debt collector for a statutory judgment.

Roger
