Legal Question in Credit and Debt Law in Pennsylvania
Is a wife liable for husband's student loan debts that husband is now not able to repay? All of these education loans are in husband's name only. Wife is not co-signer on any of them. Both husband and wife have in the past and continue to file separately and have maintained separate checkbooks, etc. What is the wife's liability, if any?
Thank you!

My 80% answer is none. If the student loans were obtained before husband and wife got together, my certainty goes up to 100%. The hedge factor depends upon whether it was a marital decision to obtain the loans during the marriage to better the financial situation for *both* parties and the immediate family unit.
Hope this helps. If you'd like to discuss your situation in further detail, feel free to contact me offline.
