Legal Question in Credit and Debt Law in Pennsylvania

Year Old Civil Complaint

Hello All,

I was served a summons for a debt from a company I never heard of. I answered the summons stating the debt was not mine it was disputed and I want proof the debt did belong to me. I also sent a copy of my answer to the company the file the complaint. I have not received anything from the company proving the debt is mine and I also still have not received a hearing or court date.

What can I do to get the complaint removed?

You are better off getting an attorney to do this for you if it is in Court. If it is in front of a Magisterial District Judge, then it may be over. If it is in Court you can handle it your self but you'll probably spend two or three weeks or months trying to figure out what to do, how to do it, driving the prothonotary's office employees crazy, and maybe even getting a judgment against you. If it is in fact not your debt, you may even be throwing away a lawsuit against the company trying to collect.
