Legal Question in Criminal Law in Pennsylvania

2nd dui in allegheny county pa

I am charged with a 2nd offense dui. My first dui was in 2000 and i was accepted into and successfully completed the ARD program. However, in 2004 when they amended the dui laws- the 'look-back' period changed from 7 to 10 years. This now made my recent dui a 2nd offense. I am over the 7 years but less than the 10. I know that i am definetly getting the 2nd dui. I am requesting a PDQ offer. What types of offers can i expect? Will i definetly spend time in the county jail even if its just a few days? Also, my recent dui was a careless driving stop. No accident or injuries. Both dui's were in allegheny county pa.

You should definitely talk to an attorney right away about your options. We can possibly negotiate a better deal with the DA.
