Legal Question in Criminal Law in Pennsylvania
18 year old providing alcohol to 15 year old
A 15 yr. old girl asked my son, 18 yrs old, to bring her to our house to drink, via the internet. He drove to her house with 2 other 17 yr. old boys and picked her and a friend up, at one in the morning. They all came back to my residence. One of the girls apparently drank some beers, until 4 a.m. The girls then asked my son to drive them back home. He refused. The girls then decided they would walk to a former boyfriend's house about 2 blocks away. They were then picked up by the cops. One was given a breathalizer test. Later that day, the ''drinking'' girl's mother calls me to tell me about this. That my son's name was given to the police as to who's house they had been drinking at. We have not heard from the police. I did search our third floor and did find beer. My husband & I were both home all night. I was in the LivRoom and did not hear the girls pass right by me. How much trouble can my son and/or my husband & I be in? We had no idea there was beer in the house. My son is an honor student and has several football scholarships pending. He has never been in any trouble. The mother says she doesn't want to involve the police(?), she just wants my son to apologize. The girl was fined $300. PLEASE ADVISE! THANKS v m

If nothing has happened with the police, you should not do anything. The police could charge your son, your husband, and yourself, with various misdemeanors, but if they haven't done this then don't do anything. The key is none of you make any statements to the police without a lawyer present. If the police question any of you, ask for a lawyer.
As far as apology to the girl goes, what is your son apologizing for? What did he do wrong? Was he supposed to drive her home? In PA the police decide when to press charges, not individual people. If the police want to press charges, they will. The pressing of charges will have nothing to do with whether the girls mother FEELS like it.
Just don't make any statements to any cops without a lawyer.
