Accused of Theft of Service
We went to a restaurant last weekend, 4 adults, 4 kids. We ordered our food. We were served 4 sodas and 1 order oftortilla chips for about ~$12. After an hour of waiting for our meals, we asked how long it would take to get our meals. The restaurant lied to us and kept telling us every 15 minutes that it was coming right out. After 1 hour and 45 minutes, we decided that we were waiting long enough and decided to leave. Also, one of the adults was sitting in a chair that broke right out from underneath him.
The restaurant wants to file a civil suit for Theft of Service, and a summons worth $86 for the meal we never ate. We feel there is some liability on their part for lying to us telling us that the food was almost ready for over 45 minutes.
Should we get a lawyer and counter sue?
