Legal Question in Criminal Law in Pennsylvania

Aggravated Indecent Assult

My new husbands 2 daughters 11 and 12 and xwife are living with her boyfriend, and we recently found out he has been convicted with the above crime in 1991. Children Services said they cannot do anything because he served his time and it was before Megans law so he might not have to register, it was up to the judge of the case I guess? We are scared for these kids and their safety. We don't know the details of the conviction, if children or adult. Can you help guide us. When we asked the girls if he ever did anything to make them feel uncomfortable, the one said no, the other hid under a blanket and wouldn't talk. We are worried he could be messing with her. Who can help us? Thanks Patty

Re: Aggravated Indecent Assult

As far as the law goes, the answers that you have above are correct. If the conviction occurred before megan's law was the law, then legally he does not have to register as a sex offender. However, you can always file for full custody of the kids and give the reason for the change in custody to be that there is a sex offender co-habitating with the kids and that you don't like that. The judge is a human being and regardless of megan's law, may do the right thing by you.
