Legal Question in Criminal Law in Pennsylvania
Alcohol Problem
A 19 year old man claims to have drank at my wedding. 4 -5 days After my wedding, he claims to have been treated for alochol poisioning.
I now have 2 charges on me. Recklessly endangering another person, and Furnishing alcohol to a minor.
I have never been in trouble before, and the sentencing outlines for both crimes indicate probation. I got my plea offer in, and it was 3-23 mos. incarceration.
Why such an exaggerated sentence? I have since fired my public defender, and got a private laywer in hopes to prove I had nothing to do with his possibly drinking.

Your lawyer is the best one to advise you why the D.A. is seeking incarceration. But it does sound to me like this is a difficult case for the prosecution unless the young man was hospitalized for those 4-5 days. If he was, that's a different story.
