Legal Question in Criminal Law in Pennsylvania
fifth amendment
my friend and i fought, there was a protection from abuse order. the order is now dropped, i never pressed charges, but he is in jail for harrassment, dis. dispute. i think the state picked up the charges, can i plead the 5th? and if so how do i do that?

Re: fifth amendment
First you must not speak to anyone except a lawyer as you would waive your privilege. Second, you need to let te prosecutor know that if called you will assert your fifth amendment privileges. The prosecutor can then imunize you and force you to testify. You should speak with a lawyer.
