ARD for DUI in Pennsylvania
I am being charged with DUI with a b.a.c. of .158. I know ARD should be available to me but,..... I was put on ARD a few years ago for an unrelated issue. I know you can only get put on ARD once in PA but I was told that the other incident is on my juvenile record which should not apply to now. I was told i should be eligible for ARD because they cant go back to juvenile records but my lawyer is not so sure. He doesnt return phone calls often and i feel like he just wants my money and is not concerned as much with the turn out. I go to court on july 9th, should i look foward to an ARD case.......?

ARD is at the discretion of the District Attorney. It all depends on local policy. Your lawyer may not have had a previous case of this nature and it's not something that he can look up. He just has to talk with the ADA handling the case to know how they treat it in that particular County.
