Legal Question in Criminal Law in Pennsylvania

Arraignment

My brother had a hearing at the magestrates office and had charges from an M2 simple assault to and M1 simple assault mutual consent. He now has an arraignment date on 3-6-08. Is it neccassary for a lawyer to be present since he was willing at the pretrial to plea guilty to the M1 charge

He does not need a lawyer for the arraignment, but he will need a lawyer for each court listing after that unless he files something to go 'pro se.' Your brother may not wish to plea guilty. If your brother does not have any prior convictions, he probably does not want to plea guilty as this would give him a record.
