Legal Question in Criminal Law in Pennsylvania

arrest for probation violation from 2001

My fiance was arrested two nights ago for a probation violation he didnt know he had, he thought he finished it. They signed him up for a public defender but hasnt seen one yet but the probation officer wants him to sign a paper to give up his rights and go straight to sentencing and we dont know if he should sign it or not. We need this taken care of quickly as he is injured and needs to continue his doctor appts.

In general it is not a good idea to waive anything with respect to criminal proceedings but this does depend on the nature of the violation. If the violation is a technical violation (for example unpaid fines or restitution) and the PO is just seeking an extension of the period of probation then he should probably just agree to it.

the answer to your question depends on two questions. first, whether he is on county or state parole/probation. second, if county, what county.

if you re-enter your question, i can give you a specific answer.
