Legal Question in Criminal Law in Pennsylvania

If an atm machine does not give me my $500 I requested with my card and it prints out a receipt saying it did and my remaning balance, can I file a criminal complaint against the bank since they refused to shut the machine down and audit the balance? I consider it theft by unlawful taking.

No you have to give the bank a chance to look into the error. Complain to the bank manager and ask them to investigate. More than likely the machine doesn't really belong to the branch so the investigation will be done by a different group than the branch.

You could also call the banks auditors and ask them to check out the problem.
