Re: Burglary

You didn't tell us if these charges were misdemeaner's or felony charges? The bottom line here is you better retain an attorney to review these charges, because you might be looking at some serious time in the state prison (5 plus years).

Call my office to discuss this matter in more detail, and do it as soon as possible, because the longer you wait the harder your defense becomes.

Sincerely,

Re: Burglary

The statutory maximum for burglary is 10-20 years. The statutory maximum for possession with intent to deliver marijuana is five years. How much time you would get if you were convicted of these charges depends on the nature and circumstances of the case itself, your prior record, if any, and other factors. One caveat - if someone was present at the time of the burglary, then this case counts as a "strike" for the three strikes and you're out rule. If you have one prior strike offense, the mandatory minimum is 20 years. If you have two prior strikes, then the mandatory sentence is either 25-50 years or 25-life. That being said, I have (and most other lawyers have) plead folks out for probationary sentences under the right circumstances. It is simply impossible to take a guess at what you might get without knowing the background information. Good luck.
