child molestation charge

if someone had a 25yr charge for rape and the DA wanted them to plead to a misdemeaner do they still get on the child preditors list or not

I don't know what you mean by a "25 yr charge for rape" but to your question about whether you would be on the Megan's Law list (which is not a child preditor list, it's a sex offender list with both adult and child victims), it depends upon which misdemeanor you are pleading guilty to. Some make you subject to the list, some do not.

Whether you are on the list depends on two main factors. The whole process is somewhat complicated, but the first part depends on the charge to which you plea guilty. Depending on the name of that charge, your analysis may end. Your lawyer may be able to negotiate that part of your plea involves that you will not be placed on the list. As far as the second part of the analysis, it depends on the actual act to which you are entering the plea. This is a complicated area and should not be taken lightly; make sure you have a lawyer talk to the DA before any plea.
