Legal Question in Criminal Law in Pennsylvania
Citation For Under-Age Drinking....
I am 20 years old and a student at a PA University. About 4 weeks ago, I was cited for underage drinking (for which I have yet to receive my report, but it's strange that my roomate whom was also cited with me did). The officer told me that I will like face fines up to $300 and suspension of my license for 3 months. I would like to know if I should attempt to plead not guilty since I was never breathalized on the scene? Would I be able to plead and get community service instead of a suspended license? Finally, if I plead guilty, what are the consequences aside from paying the fines and the suspended license? Will this show up in the future when I apply for jobs out of college? And when or how will my suspension begin? And finally, is there any way of having my license returned prior to the 3 months after pleading guilty, and remaining out of trouble. Thank You.

You didn't indicate the circumstances which led to your being arrested for underage drinking. What is the evidence against you, since you say you weren't breathalyzed.
There is always the possibility of pleading to some offense like disorderly conduct which doesn't involve suspension of license. No, you can't turn in your license before you're convicted.
Speak with an attorney.

You have been cited for a summary offense. If you plead guilty, you will have a record. You should retain an attorney to see if you can get into a diversion program, or do community service.
Alternatively, if your main concern is your license, you may want to negotiate for some other summary offense (like disorderly conduct) that would not involve anything with your license. Either way, it is in your best interest to retain an attorney. Check with the local bar association or the Pennsylvania Bar Association for referrals is your area. Good luck.
