can you be convicted of stealing from your job if the item your accussed of stealing is still in the store

Yes. There are several different charges that the store can bring against you. However, the best thing to do is to contact a lawyer if charges are in fact brought against you. Do not try to explain anything to the police or the loss prevention officer. Usually, when nothing is taken from the store the case is extremely good.
