If someone is on probation for a drug related crime, and while on probation gets involved in another case, gets out on bail and to which he is given more probation, then fails to appear at his Guilty Plea Hearing because he thought he was to await a notice, gets picked up on a Bench Warrant and taken to the County Prison. How hard would it be to help him in this instance?

the answer depends on whether the plea and violation of probation are before the same judge and whether the person has any previous violations of the probation and or failures to appear. also, the judge's own personality is always a factor. you should ask you lawyer if there would be any benefit of withdrawing the guilty plea, getting violated anticipatorily by the back judge, then 701ing the new case into the old. the reason i say this is that if the defendant if going to get whacked, this may lessen the whacking. It really depends on the judges and the county though. brian
