Legal Question in Criminal Law in Pennsylvania

I am accused by my husband of obtaining 20 percocet with his rx without his permiassion. my prelim hearing is tomorrow and was told by the pub def office that i did not qualify for representation b/c he makes too much money. i am unable to get legal help but don't know how to plead or what to do next. until i have time to get a lawyer.

First off, DO NOT WAIVE your preliminary hearing. You need to be represented by counsel. If the Public Defender will not represent you, then the Judge will ask you why you do not have an attorney. You can explain to the judge that you don't have the assets to hire someone, and the Judge should appoint an attorney for you. You have the absolute right to a lawyer at your preliminary hearing, and your husband's finances cannot be counted against you if he will not assist you in obtaining a lawyer.
