Legal Question in Criminal Law in Pennsylvania
Criminal Mischief, brother arrested, I commited it
What happened..Went to a show to see Black label Society...after my brother got drunk and disorderly, we were both thrown out. Once outside, the bouncers started taunting from behind a door, so being stupid I kicked the door and the door fell off the hinges, and a pane of glass broke.
Result: My brother was arrested for drunk in public, and 3rd degree Misdemeanor for breaking the door, 3rd degree because the damage totaled out at $700.
Problem: I broke the door, and I am willing to take the blame for it. What should I do? Do I go with him to the Prelim. and tell him to plead ''not guilty'', and tell the judge at the prelim. that I commited the act? My brother has a felony charge of drug paraphenalia from 11 years ago, while my record is 100% spotless. I would hate to see him get in trouble for something I did.
Also, on a side note, upon receiving the summons for district court, all the police reports are filed with correct name, while EVERY court paper has the last name mispelled, can we use this to our advantage?

Either one of you, your brother or yourself may be able to get a dismmissal upon satisfaction. Basically, you pay for the damage and in exchange the charges are dropped. You also pay court cost which range usually from 100-200 dollars. I highly recommend getting an attorney and pursuing this option before anybody admits to anything. I offer free consultations.
