Legal Question in Criminal Law in Pennsylvania
Criminal Procedure - Arrest Warrants
How many times can an arrest warrant be executed? For example, the police arrest someone thinking that this person is someone else. When they find that it is the wrong person, they use the same arrest warrant to arrest the person they were after all along. Do the police need to go get a new warrant since technically the warrant has already been executed?

Re: Criminal Procedure - Arrest Warrants
since Mass. v. Shepard, officers executing a warrant are forgiven their transgressions so long as they make a REASONABLE attempt to effect service. while there is no set number of times which officials my err, supression of the warrant is highly unlikely under the facts as set forth.
