In 1999, I was arrested for DUI. I was not convicted of the charges, however, I did participate in the ARD program. My lawyer told me that I would not have a record because it would be expunged. This has never come up on my state criminal record history. However, I was recently required to get an FBI fingerprint check and it is coming up on that. My question is, since it was expunged, why is it still coming up on the FBI check. Also, is there a way to remove this from my FBI criminal history?? Please advise.

If you completed the ARD program, then the record should have been expunged even from the FBI database. Apparently, the paperwork never went through or your attorney didn't do it. There is absolutely a way to have the record removed. We'd file a petition with the court, obtain an order, and serve it on the FBI. Please feel free to contact my office and we can talk about it.
