Can the Father of a child be charged w/ theft if he takes clothing for his child from the home of the mother?

The father was there to pick up the child 3mos. old...the mother allowed the father to stay there while she left for work. There is no legal custody of the child and no child support in place. After the father returned to his home he filed for custody.

I don't think the cops are going to take this one on. It's a family division case, not a criminal case.
