Legal Question in Criminal Law in Pennsylvania
my daughter was charged with 3 felony counts of intending to sell marijuana with usage of communication facility (cell phone) . I beleive the amounts were less than 1/2 oz but she was caught trying to sell to an undercover officer. They are saying the use of the cell phone is a felony. She is 19 years old, her boyfriend was with her , he was the one who supplied the marijuana and his home was searched and his keys, cell phone and wallet were seized. My daughter's (my) home was not searched. They know her boyfriend was the dealer but my daughter was involved and was charged as well. What are the chances she will be facing jail time, We have not much money and may need a public defender. I simply cannot afford an attorney at this time. Is this a mistake ? Can a public defender keep my daughter out of jail? I am worried, she was released on unsecured bail, I am hoping for the ARD program. How worried should I be?
