Legal Question in Criminal Law in Pennsylvania

digital scale possession

My friend was found in possession of marijuana and cocaine. At the time, my digital scale (which I use for legal purposes) was in his vehicle at the time of the stop. The scale is mine, and I do not use it for illegal activity. Can I be charged with a crime for claiming the scale? Can I get it back?

Before you indict yourself retain an attorney, or you can go to the police shoot your mouth off get arrested and make the situation worse for your girlfriend. Your call.

Re: digital scale possession

Find out if your friend is charged with simple possession of drugs for personal use, or if your friend is charged with possession with intent to deliver (dealing). If the government is using the presence of the scale as a factor to bump the charges up, then you could provide testimony that the scale was yours. That could help your friend, and you could end up with the scale back.

Of course, the government might very well end up arresting you and charging you with conspiracy, which you obviously do not want. Hire an attorney to take a close look at the situation and the players involved - or, just write off the scale.
