Legal Question in Criminal Law in Pennsylvania

discovery of material

My boyfriend is in prison for intent to deliever. He has a public defender,so we are working on he's case mainly throw the law library. We want to request a discovery of materials, the lady at the library said he's lawyer has to request that but the public defender isn't really doing anything besides pushing for a guilty plea. Is there any way he can request this information and how would we go about doing it??

Well, first of all, you two are not lawyers and you should not be playing with his life by mucking around in the legal system that you are not trained to do or understand.

Public defenders are lawyers, and most of them, like most lawyers, are skilled at what they do.

If you are not happy with the services you are getting from your free attorney, you are always free to find an attorney that you trust and pay him to represent you.

Ask your PD for a copy of the discovery. If they have it, they should give it to you. Don't take no for an answer. If they won't give it to you ask them why? Call a supervisor at their office. Often times the PD doesn't have the discovery until months after the arrest, so it is possible that they really don't have it.
