Legal Question in Criminal Law in Pennsylvania
dismissal
I understand that I am entitled to a speedy trial. My case has been continued three times now. Is it true that the state now has to drop the charges? I have been charged with criminal trespassing. A friend of mine told me this. Wanted to check out the validity of the claim or any course of action I may be able to undertake. Thank You for your time and response.

You must look at rule 600g. The Commonwealth has 365 from the day of your arrest plus any time delay that was caused by you or your lawyer. Also, even if the Commonwealth is over the 365, they can still get more time if they have acted with all 'due diligence' in bringing you to trial. This is a somewhat complex area of law and each case needs an individual assessment. I need more information to give you a complete answer, but i can tell you that the amount of listings is irrelevant to the analysis. Good luck.
